Another musical artist sues Epic over Fortnite emote

How will this one pan out?

When I saw the above Fortnite emote in-game, I instantly connected to New York City-based saxophonist Leo Pellegrino. I'm a big fan of his band Too Many Zooz, and would recognize Pellegrino's stylings anywhere. It seems that Pellegrino noticed it as well, and he's none too pleased.

Pellegrino is suing Fortnite for their “Phone It In” emote, which you can see in the video above. Pellegrino says the emote pilfers his “trademark moves have become inseparable from his persona and his life story” and Epic did not ask for permission to use. While I agree that this emote is 100% influenced by Pellegrino, I have a feeling his lawsuit is going to fall apart like all the others.
