Harmonix actually wants the court proceedings with Gibson over a patent to continue on, because they feel that new light on the situation will help them to come out victorious at the end. The reason why Harmonix wants to continue is because the patent now includes a line musical instruments that are "adapted for making musical sounds" and focuses on "the instrument audio signal comprising an electrical signal output by the musical instrument that varies in response to operation of the instrument by the user of the system." With this line, Harmonix believes they will be in the clear.
