November 23, 2009 by RawmeatCowboy Filed Under: DS, Nintendo in general

“Ultimately what occurs is a manipulation of hardware to extend its utility, allowing users to use with both legitimate and illegitimate purposes, but not only illegitimate. …this leads to another question that is if Nintendo has an absolute right as the only manufacturer to create accessories or, other manufacturers can produce and offer accessories for Nintendo consoles provided copies of attachments are not originally created by Nintendo and therefore protected by industrial property rights. That question goes beyond the criminal and should be terminated by the Civil Court…" - Spanish Judge

The group that Nintendo was going after was Movilquick Group, publishers of a device that lets DS users crack their device. Looks like Nintendo may have hit a bit of a stumbling block in the piracy fight.

Let's all sue spice companies for giving us the ability of adding to the flavor of food without giving any additional income to the makers of said food

It's a good decision, no matter how you look at it other than from Nintendos viewpoint. While I dislike copying/buying habits of people I know and I tell them, I wouldn't want the situation to be one where companies have a complete hold over everything as this would be incomparably worse.

@bonefish

I feel for you. So nowadays it is about what you have and didn't pay for rather than what you were able to buy? Seems it doesn't matter what direction things go, it's always coming down to people trying to one-up others some way.

Aaaarrrrrr!!!

But seriously, just remember that piracy causes "wonderful" things to be invented like the PSPgo as an attempt to counteract the piracy.

Ironically, the PSPgo is already in the process of being hacked and exploited as we speak. They've been able to put homebrew on it at least, not long before retail games.

I have an R4... I love being able to play my Super nintendo games on the go. If Nintendo can't supply that service then its their fault.

Having R4 carts being made illegal is like making egnine modifying illegal: it is somewhat dangerous, can void your warranty, but its the consumer's product so who cares?

illegally downloading games, however, is a different issue...

so you see the nintendo seal of quality was created only to avoid having people creating non licensed hardware. More to informed the consumer, but hey

The thing I hate is when people download games that are criminally undersold like Klonoa or Little King Story as examples when that means that sales are even less you know, those people who made great games deserve the money, not to have the people that would want their games to steal them. :'(

The legal status of an object shouldn't be decided by what it could be used for. Bongs and pipes come to mind...you can get those anywhere and nobody is banning them.

There are people who just like to condense their purchased game collection onto one cartridge. There are some pretty good homebrew games and applications, mp3 players, media players, cheat codes, etc...plenty of non-illegal ways to utilize it.

My God... could it be? A judge with balls? And a European one at that? The land where they ban something new every month!?

"…this leads to another question that is if Nintendo has an absolute right as the only manufacturer to create accessories..."

I... I think I just creamed myself.

So let's all pirate games and be surprised that there won't be new games to pirate very soon as companies don't get money. Sounds great.

@Wiggymaster

Germany are the ones doing the banning, we here at Iberia do nothing of the sort, heh.

My God I can't believe I refered to Spain and Portugal as "Iberia"... *shiver*

And for all you guys that think modchips/flashcarts = pirated games... well, you should check out some homebrew on a friend's DS ;) DSOrganize for the effing win.

There's not much of a real difference between flash carts and the internet. Both have many legal purposes, but it's the illegal ones that really rouse the majority of people. Would the internet be what it is today without file sharing?
