"Nintendo Australia is always pushing for games to be released here at the same time as the rest of the world, so we were pleased to get New Super Mario Bros. Wii before anyone else. Unfortunately, due to to the actions of this individual, future release dates may be affected for Australia, which is disappointing for us." - Nintendo of Australia spokesperson
Ouch...that really hurts the Aussie gamers out there. Normally you would chalk a statement like this up to a bluff, but with Nintendo you know that it could be the real deal. This is a real shame...just when Australia was getting things ironed out with their releases. Thanks to Vooks for the heads up!

I've heard that games in Australia are a lot more expensive than anywhere else in the world, is this true?

Really? Your really going to blame pirates for release dates in a country whose censorship laws are so strict that they recently made it illegal to own pornography with small breasted women in it? Or a country that demands that most M rated games have to be censored to the umpteenth power to be released (ala L4D2)?
Stop picking pirates as the damn scapegoat for everything. Is what they do wrong? To an extent, yes. Are they the cause for world hunger? No.

anywhos, just release the games on the same day instead of beforehand, then. less lost purchases that way.

I, personally, wasn't arguing that what the guy did wasn't bad (as I had reasserted numerous times to avoid replies like these), but that the punishment wasn't proportional to the amount of damage he did.

I still think the $1.5 million is way too much money for what the guy did. Australia, like Weasler mentioned, has strict censorship and their game prices are high. I think they have more important problems to worry about than piracy.

And this is why I'll probably never go live in Australia. Because while the country itself seems like a great place, the games cost a bundle and the censorship is a drag.

His punishment isn't proportional to the amount of damage he did; it's probably less than the cost of all the illegal downloads, actually, considering how many times it was downloaded (I don't know the number) and the different prices the game might see in different areas (I don't know those numbers, either).
Also, @ the censorship thing, Japan can't show uncensored wangs. What's the reason? I don't care, it's annoying. Point is, every society is different, and looking at it from the outside is probably unfair.

A pretty large amount of people did pirate this game, and dude deserved to be punished, but I'm not exactly sure his upload made it to as many people as some of y'all would theorize, given the fact that multiple release groups (as well as dozens of regular ol' pirates) uploaded this game as soon as they could get their grubs on it.
And dude, trust me, as far as censorship goes, Australia is absolutely batshit on a level no other country will ever reach.

Search 'Australia' on Joystiq or Kotaku if you want some details on just about every game that's ever been denied classification in Australia (see, the government over there doesn't like the idea of an 18+ rating because apparently, people can't think for themselves and will repeat everything they see on TV or in games or something), or if you do a little digging on news sites or google, you can find examples of the Australian Prime Minister's weird ass, almost draconian policies on everything ever (especially media in all of its forms).

It's not Nintendo's problem to take into account what limitation and laws regarding censorship that the Australian government chooses to self impose on itself. Nintendo is in the business of making games and profiting off of said games just like any other developer involved in the business, not politics and writing policy for Australia to allow better and fairer distribution of games.
It really is too bad that this douchebag did what he did because Nintendo is one of the few game makers who doesn't make games subject to Australia's crazy censorship becuase the majority of their games are E to Teen and now the Aussies possibly won't even have Nintendo's games as soon or at all compared to before this. Australia has alot of things that they need to work out when it comes to videogames and the entertainment sector in general though that's for sure.

One of the reasons I pirate games are because of release dates - I don't like to wait.
When Super Smash Bros Brawl is released in the US on March 9, and there's no release date set for Europe (turned out to be June 27), of course I'm going to pirate the frickin' game!
1. Don't make me wait
2. Make the customers feel like they're getting extra value by buying the stuff
3. Stop treating your customers like criminals
4. Don't make it so that the pirated version is better than the legit one (i.e., most DRM schemes -- annoying for legitimate users, not a problem for pirates once someone cracks it)

I'd say the recommended retail prices in Australia are an absolute joke, but it doesn't take too long for that high figure to come down to US standards. Retail stores know that people will pay whatever is asked on day one, so that's where they put them.
And unfortunately, Nintendo keeps their RRP prices pretty damn high because their product keeps flying off the shelves.
But if you do your research, you will end up paying equal to or even less than other countries for games.

too bad... unfortunately for Nintendo, this will back fire. People wanting to play the game sooner will inevitably download it. They need to be smarter and not "punish" their customers...

Nintendo of Australia is using this as an excuse to be even more pathetic. The whole thing; a big fat publicity stunt.
Ways NCL could have damaged controlled:
-Not let Nintendo Australia send the game out to retailers weeks early on trusting them to do the right thing (this is the bit to blame Nintendo Australia for, there would be no early leak if it wasn't for this)
-Made the game larger than 400MB (even with dial-up that is downloadable)
-Made the BCA protection well...good?
Still remember a few years ago when Super Mario Galaxy got leaked? It was due to Nintendo America giving out the final game as kiosk demos for Gamestop. The result of that...erm, NoA stopped releasing gam*...I've not heard of any more Wii game demo kiosks.
*-Actually, that is a pretty good one (Disaster, Trace Memory)

New, popular games that they know will sell can now fetch as much as $120. You'll be lucky to find those same games for less than $100 dollars in the *used* section, even a few months later. Why every game store has decided to become a shameless rapist in recent years I do not know.
There's never been a better time to start downloading.
