Ex-Factor 5 Employees Sue Company For Fraud, Canned Rogue Squadron Wii Game Involved?

Factor 5 is having one hell of a bad time lately. Everything seemed to go downhill after the launch of Lair, which was not exactly the greatest display of Factor 5’s talent.

Now we learn that some ex-Factor 5 employees are suing Factor 5 for ‘allegedly fraudulently conveying intellectual property to another company prior to declaring bankruptcy, in order to avoid paying employees and debtors’.

“We allege in the suit that Factor 5 and its three founders fraudulently transferred assets, including source code and other intellectual property to Blue Harvest, which is now known as White Harvest. We believe and have alleged in the complaint that Factor 5 and White Harvest are essentially the same company, being run by the same people, being represented by the same sets of lawyers, with all the same management and ownership and control, performing all the same work that they were doing at Factor 5, just now with a new name and a new address.” - plaintiffs’ lawyer James Smith

As you can see, this is going to get very ugly. The lawsuit also seems to mention what could have been a canned Star Wars Wii title that fits in with the Rogue Squadron series. Are we going to miss out on this due to the lawsuit.
